Internatiol transportation regulations
In these Rules, the terms and their definitions mean the following:
Agent is a person or organization authorized to act for a carrier or for another person or organization, as well as on their behalf.
Property Irregularity Report (PIR), Cargo Irregularity Report (CIR) is a document issued by the carrier in the presence of the passenger (receiver) immediately upon the detection of damage caused to the baggage (cargo), the carriage of which was performed by the aircraft of one or several carriers. The act is signed by the carrier and the passenger (receiver).
Airport (point) of destination is the airport (point) to which the passenger, baggage or cargo are to be delivered, in accordance with the contract of international air transportation.
Stopover airport (point) is an intermediate airport (point) in which the passenger under the contract of international air transportation temporarily interrupts the flight.
Airport (point) of departure is an airport (point), from which, according to the contract of international air transportation, the passenger, baggage or cargo transportation begins.
Airport (point) of the transfer is the airport (point) indicated in the ticket or air waybill, in which, according to the contract of international air transportation, the passenger carries out transfer or transshipment of cargo from one flight to another is carried out for further transportation along the transportation route.
Baggage - personal belongings of the passenger, transported on an aircraft by agreement with the carrier. The term "baggage" refers to both registered and unregistered baggage.
Registered Baggage - the passenger's baggage, which the carrier accepted for carriage under his responsibility for its safety and for which he issued a baggage receipt and a baggage tag.
Baggage tag - a document issued by the carrier solely for the recognition of registered baggage.
Unregistered baggage - the passenger's baggage, which during transportation is in the cabin of the aircraft with the consent of the carrier and certified by the tag "In the salon".
Unaccompanied Baggage - baggage accepted for carriage separately from the passenger and registered by waybill as cargo.
Excess baggage is a part of the whole baggage that exceeds the free baggage allowance set by the carrier or requires compulsory payment irrespective of the specified rate.
Ticket (passenger ticket and baggage check) is a transportation document certifying the conclusion of a contract and the conditions for the international air carriage of a passenger and his baggage.
Booking - preliminary allocation on the aircraft of places for the carriage of passengers, as well as the volume and tonnage for the carriage of baggage and cargo.
Refund of amounts - payment to the passenger (consignor) or to the person representing it, part or all of the cost of transportation or services that he had previously paid for, but not used.
«Turkmenhovayollary» Service - is the body of the state and economic management of the civil aviation of Turkmenistan, which is responsible to the President of Turkmenistan and the Cabinet of Ministers of Turkmenistan for fulfilling the tasks and functions assigned to it.
Cargo - property that is transported or accepted for carriage on aircraft in accordance with an air waybill.
Air waybill is a transportation document certifying the conclusion of a contract and the conditions for the international carriage of goods by air, as well as acceptance by the carrier of cargo from the consignor.
Cargo dispatch is one or several cargo places that are simultaneously accepted by the carrier from one consignor and are transported by one air waybill to the same addressee.
Cargo consignment is a cargo accepted for transportation from one consignor to one or several consignees under several air waybills.
Transit cargo is a cargo that, according to the air waybill, is transported further by the same flight to which it was delivered to the intermediate point.
Transfer cargo is a cargo that, according to the air waybill, is delivered to the transfer point by one flight, and then it is transported by another flight of the same or another carrier.
A valuable cargo is a cargo, the actual value of which is 300 US dollars or more per kilogram or that contains gold in coins, bars or sand, platinum, silver, other precious metals, precious or semiprecious stones, including industrial diamonds, currency in currency or coins, shares, bonds, coupons, outstanding postage stamps and other securities, as well as jewelry, which are transported under special conditions established by the carrier.
Days are full calendar days, including Sundays and official holidays. In order to determine the validity of shipping documents, acts and other documents, as well as to determine the deadlines for the completion of carriage, the statute of limitations for the filing of claims, the days account is conducted from 00 hours of the day following the day when the event occurred or the action is taken, and the rest of hours of that day is not considered. If the end of any deadlines indicated earlier falls on a Sunday or a holiday, the expiry of the term is determined by the day following it.
The chartering contract (charter) for aircraft is an agreement under which one party (the charterer) undertakes to provide to the other party (the charteree) for a payment all capacity or part of the capacity of one or several aircraft for one or several flights for the carriage of passengers, baggage or cargo.
Receipt of paid baggage is a document certifying payment for the carriage of baggage in excess of the norm of free transportation or items, the carriage of which is subject to mandatory payment, as well as certifying payment of fees for the declared value of baggage.
Miscellaneous Charges Order (MSO) is a payment document issued to the passenger by the carrier or its agent, which contains a request to issue a ticket, a receipt of paid baggage or to provide other paid services for the person specified in this document.
A stopover is a temporary break agreed by the passenger and the carrier concerned the passenger and his baggage at some point between the departure and destination points.
The consignor is a legal or natural person specified in the air waybill as the consignor of the goods.
Passenger is any person, except for the crew members, which is transported or is to be transported on the aircraft in accordance with the air transport contract.
Passenger coupon (coupon "For the passenger") is the part of the ticket certifying the conclusion of the contract of international air carriage of the passenger and his baggage.
A transit passenger is a passenger who, in accordance with the contract of international air transportation, is further transported by the same flight to which he arrived to the intermediate airport.
A transfer passenger is a passenger who, in accordance with the contract of international air transportation, is delivered to the transfer point by one flight, and then is transported by another flight of the same or another carrier.
Carriage on credit (CC-Charges Collect) - transportation of cargo with payment of the established fare and due charges in destination point at delivery of cargo to the consignee.
International transportation - transportation carried out in accordance with the contract of international air transportation, where the point of departure and destination, regardless of whether there was an overload or a break in transportation, are located:
1) on the territory of two states;
2) on the territory of the same state, if there is a stop in the territory of another state.
Mixed Transportation - transportation of a passenger, baggage or cargo, carried out by carriers of different modes of transport.
The carrier is an aviation enterprise (airline) of the Turkmenistan Airlines OJSC, which issues transportation documents and carries out or undertakes to carry out international air carriage in accordance with such documents, as well as provides or undertakes to provide services related to such transshipment.
Endorsement means the written consent of the carrier issuing the transportation or payment document or the carrier indicated in the relevant flight coupon of the ticket in the air waybill or exchange coupon of the payment document, for the carriage of the other carrier or for the exchange of the originally issued transfer or payment document.
Flight coupon is a part of the ticket, giving the passenger the right to transport between the points indicated therein.
The consignee is a legal entity or an individual named in the air waybill as the consignee of the goods.
Claim - written request of an interested person for compensation of damage (losses) arising as a result of international air transportation.
Regular Flight is the flight of an aircraft, performed along the route in accordance with the established schedule.
An additional flight is the flight of the aircraft, performed in addition to the same route on which the scheduled flights are carried out.
Charter flight is the flight of an aircraft, performed in accordance with the contract of chartering an aircraft.
Collection is the amount approved by the established procedure, collected by the carrier or other competent authorities when transporting passengers, baggage and cargo.
Fare - the amount, approved in the established procedure, charged by the carrier for the transfer of one passenger or For transportation of a unit of mass or volume of baggage or cargo from the point of departure to the point of destination along a certain route.
Charter - see charter (charter) contract for aircraft.
Electronic passenger ticket and baggage receipt - is a document used in the provision of services to passengers, booking air transportation, charging fees and collections, in which information about the service, fee or collection is presented in electronic form. The electronic passenger ticket and baggage receipt has a certain structure and content and includes a route/receipt (an extract from the automated booking system). The route/receipt is a strict reporting form.
APPLICATION OF THE RULES FOR INTERNATIONAL AIR TRANSPORTATION OF PASSENGERS, BAGGAGE AND CARGO
SECTION 1. APPLICATION OF THE RULES
1.5. GENERAL PROVISIONS
The present Rules apply to any transportation of passengers, baggage and cargo, including related services, which are carried out by the airlines of Turkmenistan Airlines OJSC (carriers) for a fee, if, according to these Rules, these shipments are international.
The present Rules are the rules of transportation of Turkmenistan Airlines OJSC, to which reference is made in the ticket and air waybill.
1.2. COMPLIANCE WITH LAWS AND REQUIREMENTS
OF GOVERNMENT AUTHORITIES
1.2.1 All rights and obligations arising from an international air transport contract are governed by the following documents:
Provisions of existing multilateral and bilateral international contracts of Turkmenistan;
The Air Code of Turkmenistan and other legislative acts of Turkmenistan;
The present Rules;
Agreements, for which Turkmenistan Airlines OJSC or, included in its composition are participants.
1.2.2 Carriage carried out in accordance with these Regulations shall be subject to the relevant laws, regulations, rules and provisions of the state authorities of any country, to the territory, from the territory or through the territory of which such transportation is carried out.
1.2.3 If any provisions indicated in the ticket, air waybill or in the present Regulations, are in conflict with the laws, regulations, rules and provisions of the government of the country concerned, which can not be changed by agreement of the parties to the contract of international air transportation, then such provisions remain in force and are considered as the part of the contract of carriage only to the extent that they do not conflict with the specified laws, regulations, rules, and provisions.
However, the invalidity of any provision of these Rules should not affect the rights of third parties.
1.3. FREE OF CHARGE TRANSPORTATION
The present Rules apply to free of charge, including official, transportation of passengers, baggage and cargo, unless otherwise expressly provided for by relevant contracts, instructions and rules for application of fares of Turkmenistan Airlines OJSC.
1.4. CHARTER TRANSPORTATIONS
The present Rules apply to international transportations performed by charter flight of the Carrier in pursuance of a charter contract for aircraft concluded by the Carrier or on its behalf with the charterer, as otherwise not established by such agreement or by special rules of charter transportation.
The responsibility of the charterer to passengers, consignors and consignees is determined by these Rules.
The consent of the passenger to follow by a charter flight or the consignor's consent to ship cargo by a charter flight is considered as their agreement with all the terms of the charter contract of the aircraft relating to the conditions of carriage, irrespective of whether this contract is concluded directly with the passenger, consignor or with another person.
1.5. CHANGING THE RULES
The present Rules, regulations and other documents regulating the terms of transportation, fares and charges may be changed by Turkmenistan Airlines OJSC without notification.
Changes, additions or cancellation of these Rules can only be carried out by Turkmenistan Airlines OJSC.
1.6. TRAFFIC DOCUMENTS
1.6.1 The traffic documents include a ticket, baggage receipt, an electronic passenger ticket and a baggage receipt, a waybill, other documents used for the provision of services for air transportation of passengers, baggage, cargo, and provided for by the regulatory legal acts of Turkmenistan.
1.6.2 The contract of air transportation of a passenger, baggage, cargo is certified accordingly by a ticket, baggage receipt, an electronic passenger ticket and a baggage receipt, and an air waybill.
1.6.3 The ticket, baggage receipt, other documents used in the provision of services for the air transportation of passengers can be issued electronically (an electronic transportation document) with information about the conditions of the contract of air transportation in the automated system of air travel booking. When using an electronic transportation document, the passenger is entitled to demand, and the carrier or the agent acting on the basis of the contract with the carrier, must issue a route/receipt containing a reference to the conditions of the relevant air transport contract in the automated air travel booking system when concluding the contract of carriage or passenger registration.
1.6.4 Forms of the ticket, baggage receipt, electronic passenger ticket and baggage receipt, air waybill, other documents used in the provision of services for the air transportation of passengers, baggage, and cargo are established by the Turkmenistan Airlines OJSC.
1.6.5 At the request of the court, prosecutor's offices, internal affairs bodies, tax authorities, customs authorities, information about the electronic transport document is transmitted by the carrier or acting agent on the basis of the contract with the carrier in the form of a route/receipt (extracts from the automated booking system).
1.6.6 To account for the air transportation of passengers by the carrier or the agent acting on the basis of the contract with the carrier, a register of shipping documents is kept on the basis of information contained in the automated booking system for air transportation.
1.6.7 The register of transportation documents is kept in electronic and paper form and must contain information about the payment for air transportation of passengers, baggage, and cargo, indicating the points of departure and destination and other necessary information.
RULES FOR INTERNATIONAL AIR TRANSPORT
OF PASSENGERS AND BAGGAGE
SECTION 2. TICKET
2.1. GENERAL PROVISIONS
2.1.1 A ticket is a document certifying the conclusion of a contract and the conditions for the international air carriage of a passenger. The terms of the contract contained in the ticket are a summary of the provisions of these Rules.
2.1.2 A passenger is admitted to transportation only if he has a valid ticket duly registered and issued by the carrier, the Carrier's agent or a foreign carrier whose ticket is recognized as valid for the carriage of the passenger and his baggage on the lines of Turkmenistan Airlines OJSC.
A passenger is not allowed to be transported if the ticket he presents contains corrections or changes made to it by a person other than the Carrier or the agent of the Carrier.
2.1.3 The ticket is issued only after payment of the corresponding fare in cash. The issue of a ticket by bank transfer or free of charge can be made only after all the requirements established by the rules and instructions of Turkmenistan Airlines OJSC are complied with.
2.1.4 The name of carriers - Turkmenistan Airlines OJSC in the ticket can be indicated in abbreviated form.
2.2. VALIDITY OF TICKET
2.2.1 The ticket is valid for the carriage of the passenger and his baggage from the point of departure to the destination point along the route and the class of service indicated therein. Each flight coupon is valid for the carriage of the passenger and his baggage only for the specified section of the route, class of service, date and flight for which the seat is reserved.
If the ticket is issued without a booking mark (with an open departure date), the seat is booked in accordance with the passenger's request if there are vacant seats on the requested flight.
The place and date of issue of the ticket must be indicated in all its flight coupons.
2.2.2 A ticket issued at the normal rate is valid for the carriage of the passenger and his baggage during the year, counting from the date of the start of the carriage, and if none of the flight coupons has been used, then from the date of issuance of the ticket.
2.2.3 A ticket issued at a special rate is valid for the carriage of a passenger and his baggage within the time limits established by the rules for the application of this fare.
2.3. EXTENSION OF VALIDITY OF THE TICKET
2.3.1 The validity of the ticket is extended to the nearest Carrier flight at which there is a free seat of that class of service that corresponds to the originally paid fare if the passenger was unable to fly during the validity period of the ticket in the following cases:
The cancellation of the flight for which the passenger has been booked;
The cancellation of an aircraft stop on a schedule of traffic at a point which for the passenger is the point of departure, destination, stopover;
Failure to comply with the time specified in the timetable;
Failure to provide services for the class indicated in the ticket;
Failure to provide to the passenger the previously booked seat in the aircraft.
In these cases, the validity of the ticket is renewed at no additional cost.
2.3.2 If a passenger who has a ticket paid for a normal or special fare with an one-year ticket validity term applies for a booking of a seat and the Carrier is unable to provide a seat during the validity period of the ticket, the validity of such ticket is extended to the nearest Carrier flight, on which there is an empty seat of that class of service, which corresponds to the originally paid fare.
2.3.3 If the passenger has not been able to complete the flight that began during the validity of the ticket due to his illness or illness of a member of his family following him on an aircraft, the validity of such ticket is extended until the date when, according to the medical opinion, he or a member of his family will be able to fly, or after that date to the nearest Carrier flight, which has available seats in the class of service corresponding to the originally paid fare. The rules for application of fares by Turkmenistan Airlines OJSC may provide for a different procedure.
If one (or more) stop on the way is provided in a ticket paid for by a normal or special fare with a validity period of one year's ticket, the validity of such ticket is extended no more than 3 months from the date indicated in the medical report, and in the case other validity period of the ticket not more than 7 days.
In these cases, the validity of the tickets of family members accompanying a sick passenger is extended for the same period.
2.4. SEQUENCE OF ACTION OF COUPONS
AND THE ORDER OF THEIR PRESENTATION
The passenger is obliged to submit to the Carrier a ticket with flight and passenger coupons.
The carrier accepts flight coupons for the carriage of the passenger and his baggage only sequentially, starting with the point of departure indicated in the passenger coupon. The ticket is not valid for the carriage of the passenger and the return of money with an unused flight coupon, if the subsequent flight coupons have already been used.
The passenger coupon and all unused flight coupons must be kept by the passenger during the whole transportation. They must be presented and handed over to the Carrier at its request.
2.5. PROHIBITION OF TICKET TRANSFER
The ticket can not be transferred and used by another person. The person who presented the ticket to the name of another person is not entitled to transportation.
2.6. LOSS OR LACK OF TICKET
2.6.1 A person who does not have or does not produce a valid and duly issued ticket containing the passenger and relevant flight coupons is not allowed to be transported.
2.6.2 In the event of loss, damage to the ticket or any part thereof, or in the event of the presentation of a ticket in which there is no passenger or flight coupons, the carrier may, at the request of the passenger, issue a new ticket in exchange for such ticket, with charges levied by the rules and instructions of Turkmenistan Airlines OJSC .
In the event of loss, damage to the ticket (or any part thereof) issued by a foreign carrier with which the Carrier has an interline agreement (an agreement on mutual recognition of shipping documents), it is necessary to obtain permission from the carrier for a duplicate.
In these cases, the passenger must provide satisfactory evidence to the carrier that he has indeed been issued a ticket for the flight along the appropriate route. The passenger must also give in written form a guarantee obligation to reimburse the carrier (within the applicable fare for the new ticket) losses that the carrier may incur if the lost ticket or missing flight coupons will be used by someone or a refund will be made.
2.6.3 Incorrect registration, damage or loss of a ticket does not affect the existence or validity of the contract of carriage. Transportation can be carried out only when restoring or confirming the validity of an incorrectly issued or damaged ticket by the signature of the official authorized to do so - the representative of the carrier.
SECTION 3. BOOKING OF SEATS
3.1. GENERAL PROVISIONS
3.1.1 Booking of seats is a prerequisite for passenger transportation.
3.1.2 Until the passenger is issued a properly registered ticket, the booking is considered preliminary and can be canceled if necessary.
3.1.3 A passenger who has a completely or partially unused ticket and wishes to postpone the departure date specified in the ticket for a different period does not enjoy any preemptive priority rights in the case of a new booking of the seat.
3.1.4 The carrier is not required to provide the passenger with any particular place on the board of the aircraft. The purchase of the ticket by a passenger means his consent to any place that will be provided to him on the board with a service in the class indicated in his ticket.
3.2. TIME OF ARRIVAL OF THE PASSENGER FOR REGISTRATION
3.2.1 The passenger is obliged to arrive for registration at the airport or in other designated by the carrier the place of departure, not later than the time fixed by carrier or in such a way to fulfill the formalities and registration procedures.
3.2.2 If the passenger did not arrive on time for registration or arrived without the appropriate document or with invalid documents (ticket, passport or other identity document, necessary documents certifying the special conditions of transportation of the passenger, namely the power of attorney for the child, medical certificate, veterinary certificate etc.), or improper or missing entry/exit documents, immigration documents, the carrier may cancel the booking for such passenger.
The carrier shall not be liable to the passenger for losses resulting from the late arrival of the passenger for registration.
3.3. CONFIRMATION OF BOOKING
3.3.1 In case of a stop in transit and in return point over 72 hours a passenger must confirm at the carrier previously booking a flight, not later than 72 hours before the scheduled departure time, and no later than 2 hours at the point of transfer after arrival.
3.3.2 If a group of passengers, organized for a trip with the common goal of the same route, consisting of 10 or more people who have tickets with a note of booking for further flight or flying in the opposite direction, making a stop at any point for more than 15 days, the booking must be confirmed no later than 15 days before the flight departure.
3.3.3 To confirm the booking the passenger (and in the case of transport groups - the head of the group) should apply to the representation of Turkmenistan Airlines OJSC or its agent by the phone/telex, fax or in person.
3.3.4 In case of non-fulfillment of the requirements specified in this article, the Carrier is entitled to cancel the booking.
3.4. CHARGES ASSOCIATED WITH REFUSAL FROM RESERVED PLACES AND PASSENGER NOT COMING FOR REGISTRATION
If the passenger (group of passengers) refuses the reserved seat or does not arrive to the place of registration by the time established by the Carrier, or arrived without the appropriate document or with invalid documents (ticket, passport or other identification document, necessary documents certifying special conditions of transportation of this passenger, namely, a power of attorney for the child, the medical report, health certificate, etc.) or misfiled or missing entry/exit documents, immigration documents, resulting in not using of booked place for such passenger, then the passenger (from the group of passengers) shall pay the collection in cases and amounts provided for by appropriate instructions of Turkmenistan Airlines OJSC .
However, such fee is not charged if the passenger (group of passengers) could not cancel the booking or could not arrive to the place of registration due to cancellation or delay of the flight, overflight of the landing point according to the schedule or failure to provide this passenger (group of passengers) with the reserved seat.
The fee is also not collected if the passenger (several members of the group) has not arrived to the place of registration for health reasons, confirmed by medical certificate.
3.5. COMMUNICATION EXPENSES AT BOOKING
Communication costs by the carrier to the passenger, at his request, concerning his travel and booking, except for communications that concern to the original booking, are to be paid by the passenger.
3.6. CANCELLATION OF BOOKING FOR FOLLOW-UP
If the passenger did not use the booked seat for him, the Carrier is entitled to cancel the booking for the next section of the route or for the return flight, which the carrier has made himself or by his request was made by others, including foreign carrier for that passenger.
SECTION 4. STOPOVER
4.1 Stopping in transit is permitted only on condition that it is previously agreed with the Carrier or with the Carrier's agent and is provided for in the ticket.
4.2 If the ticket is paid at the normal rate, the passenger is allowed to make stops on the way at any point along the route.
If the ticket is paid at a special rate, the passenger stops on the way are governed by the rules for applying this special fare.
In any of these cases of payment for a stopover ticket, the following conditions must be met:
A stop is made within the validity period of the ticket;
The stop is allowed by the rules of the state bodies of the respective countries and their carriers.
SECTION 5. RATES AND CHARGES
5.1 GENERAL PROVISIONS FOR APPLICATION
OF FARES AND CHARGES
5.1.1 Fares are applied only for payment of transportation from the point of departure to the destination point.
The fare does not include the cost of land transportation between airports or between the airport and the city center, except when the rules and instructions of Turkmenistan Airlines OJSC provide that such land transportation is carried out without charging an additional fee.
5.1.2 The application of fees for declaring the value of baggage, stopping on the way and other types of fees is governed by the rules of application of fares and instructions of Turkmenistan Airlines OJSC .
5.1.3 For transportation regulated by these Rules, fares published by Turkmenistan Airlines OJSC are applied. In the absence of published fares, fares are being used, constructed in accordance with the rules for application of fares and the corresponding instructions of Turkmenistan Airlines OJSC .
5.1.4 If the rules for application of fares for the Turkmenistan Airlines OJSC do not provide for a different procedure, the fare that applies on the day of commencement of carriage specified in the first flight coupon of the ticket shall be applied.
5.1.5 If the paid amount does not correspond to the applicable fare, the difference must either be paid by the passenger or returned to him in accordance with the rules of application of fares of Turkmenistan Airlines OJSC .
5.2. THE RULES OF APPLICATION OF FARES
5.2.1 Published through fares shall prevail over any unpublished fares built in accordance with the rules for application of fares of Turkmenistan Airlines OJSC for transportation with a service of the same class, between the same points and along the same route.
5.2.2 An unpublished fare, constructed by using the amounts of a proportional and published fare, has priority over any combination of district fares or a fare built using a mile system.
5.3. CURRENCY OF PAYMENT OF FARES AND FEES
5.3.1 Fares and fees may be paid in any currency accepted by the Carrier and air travel agencies, subject to the laws and regulations of Turkmenistan and the countries concerned on currency transactions.
5.3.2 If the payment for transportation is made in a currency other than the currency of the published fare, then the current bank rate of currencies used by the Carrier or by the air carrier is used. The bulletin of the current exchange rates must be presented to the passenger by the Carrier or by the agent of the Carrier when paying the fare for international transportation.
5.4. FAILURE FROM TRANSPORTATION FOR NON-PAYMENT
OF FARES AND COSTS
The carrier is not required to carry out transportation of passenger or his baggage and may refuse to continue such carriage if it has not been paid in accordance with the applicable fares or if the relevant charges are not paid.
In these cases, the passenger must be refunded the previously received amounts in accordance with the provisions set out in subitems 11.3.2 and 11.3.3 of this Regulation.
SECTION 6. CHANGES IN TICKET AND TRANSPORTATION
6.1. CHANGES IN THE TICKET BY REQUEST OF THE PASSENGER
Changes in the ticket at the passenger's request are made in accordance with the instructions of Turkmenistan Airlines OJSC .
6.2. CHANGES IN TRANSPORTATION
6.2.1 If the Carrier:
Canceled the flight;
Did not ensure compliance with the schedule;
Replaced one type of aircraft or class of service to another;
Could not provide the passenger with a previously reserved seat;
Did not provide matching with the flight for which the passenger was booked a seat,
Then, taking into account the reasonable interests of the passenger, the Carrier is obliged:
To transport the passenger by another regular flight on which there are vacant seats, or to ensure transportation of the passenger to the destination on the other route by the regular flight of the Carrier, or a regular flight of the foreign carrier, or to provide transportation of the passenger by means of land transport.
The carrier must not demand the payment of additional fares and fees in connection with such changes in transportation. However, if the passenger fare and the fare for transportation of baggage in excess of the free baggage allowance for the changed route are below the paid amount, the difference must be returned to the passenger.
6.2.2 If the Carrier for any reason can not provide the passenger with a seat in accordance with the booking made in the cabin of the corresponding class of service, then:
If the passenger agrees to follow in the cabin of another class of service with the provision of food and the right of free baggage allowance according to the rates corresponding to the initial booking, no recalculations are made on the difference between the cost of transportation in one class and another class of service;
If the passenger refuses to follow in the cabin of another, cheaper class of service, the Carrier shall bear reasonable expenses for the accommodation of this passenger in the hotel, meals, use of communications and ground transportation when moving to the airport and from the airport until such time as he can provide the passenger seat in accordance with the initial booking on the flight of the Carrier or on the flight of a foreign carrier.
SECTION 7. REFUSAL TO TRANSPORT ANY PASSENGER
7.1. THE RIGHT OF REFUSAL OF TRANSPORTATION
The carrier is entitled to refuse transportation (both original and subsequent), cancel the booking made for the passenger or remove the passenger from the aircraft:
- in order to ensure flight safety;
- in order to prevent violations of relevant laws, rules, regulations and orders of state authorities of any country on the territory from which or through the territory of which the transportation is carried out;
- when the passenger has incorrectly executed documents;
- when the passenger's behavior, age, mental or physical condition is such that:
- require special assistance from the Carrier;
- create confusion, inconvenience or cause objections from other passengers;
- represent danger or risk to the passenger, other persons or their property;
- due to the passenger's refusal to comply with the rules, instructions of Turkmenistan Airlines OJSC and the instructions of the Carrier.
7.2. THE RIGHT OF THE PASSENGER IN A CASE OF
FAILURE FROM TRANSPORTATION
If the passenger is refused transportation or is not admitted to the aircraft or taken off the aircraft for the reasons specified in items 7.1 of this Regulations, he is entitled only to refund the amount for an unused ticket or a part thereof in accordance with subitem 11.3.2 of the present Rules and rules for application of fares of Turkmenistan Airlines OJSC .
In case the passenger is refused transportation due to the reasons stated in subitems 4c) and 5) of item 7.1, from him, when returning money for an unused ticket or a part thereof, corresponding charges are also collected.
7.3. LIMITATIONS ON COMMERCIAL LOADING
If the limits for the admissible commercial loading of an aircraft are established for safety reasons, the Carrier is entitled to decide at his own discretion which of the passengers and what baggage is not liable to be transported on this aircraft.
SECTION 8. TRANSPORTATION CONDITIONS
FOR SOME CATEGORIES OF PASSENGERS
8.1. TRANSPORTATION OF ESPECIALLY
To the category of especially important passengers are persons identified by the special list of Turkmenistan Airlines OJSC unless otherwise provided by the requirements of the state bodies of the country concerned. Transportation of especially important passengers is carried out in accordance with the requirements of government agencies, rules and instructions of Turkmenistan Airlines OJSC.
8.2. TRANSPORTATION OF DIPLOMATIC COURIERS,
Transportation of diplomatic couriers and diplomatic mail is carried out in accordance with the requirements of government agencies, rules and instructions of Turkmenistan Airlines OJSC .
The diplomatic courier must have and represent at the request of the Carrier documents confirming his special authority as a person accompanying diplomatic baggage (mail).
8.3. TRANSPORTATION OF DEPORTED PASSENGERS AND PASSENGERS, WHICH WAS REFUSED IN THE ENTRY
INTO THE COUNTRY
Transportation of deported passengers and passengers denied entry into the country is carried out in accordance with the requirements of relevant government agencies, rules and instructions of Turkmenistan Airlines OJSC.
8.4. TRANSPORTATION OF CHILDREN
8.4.1 Children on Turkmenistan Airlines OJSC can be transported accompanied or unaccompanied by adult passengers.
As unaccompanied children, children between the ages of 2 and 12 who can travel without their parents and are not entrusted to any of the passengers can be transported. At the request of parents or guardians, this may apply to children under 16 years of age.
Unaccompanied children are accepted for transportation only after registration by the parents or guardians the relevant document ("Application for transportation"), indicating all the necessary details of such transportation.
8.4.2 For the carriage of one child under 2 years of age who does not occupy a separate place and is accompanied by an adult passenger, 10% of the corresponding normal or special fare of the accompanying adult passenger is paid, unless there are special conditions for the application of this fare.
8.4.3 If a child under 2 years is transported with a separate seat, 50% of the corresponding normal or special fare of the accompanying adult passenger is paid for his transportation, unless there are special conditions for the application of this fare.
8.4.4 For the carriage by one adult passenger of the second and subsequent children in the age up to 2 years 50% of the corresponding normal or special fare of the accompanying adult passenger is paid, unless there are special conditions for the application of this fare.
8.4.5 For the carriage of every child between the ages from 2 to 12 years, accompanied by one adult passenger, 50% of the corresponding normal or special fare of the accompanying adult passenger is paid, unless there are special conditions for the application of this fare.
8.4.6 For transportation of an unaccompanied child under the age of 8 years, 100% of the corresponding normal fare is paid.
8.4.7 For transportation of an unaccompanied child between the ages of 8 and 12, 50% of the corresponding normal fare is paid.
8.4.8 Regardless of age, each child who is paid for transportation of 50% of the corresponding normal or special fare is given a separate seat and free baggage allowance is allowed at the rate established for passengers who have paid a normal or special fare. If in these cases baggage is transported in an amount exceeding the free baggage allowance, it is paid for at the appropriate baggage rate.
8.4.9 Children who go to their destination with payment of 10% of the corresponding normal or special fare are not entitled to free of charge baggage allowance.
8.5. TRANSPORTATION OF ELDERLY AND SICK PASSENGERS
8.5.1 If the age, mental or physical condition of the passenger can cause aggravation of his health or create a danger to his life, the passenger is transported on condition that the Carrier is not liable for the consequences resulting from these reasons.
The service provided to elderly and sick passengers is carried out according to the instructions of Turkmenistan Airlines OJSC.
8.5.2 For transportation of a passenger who needs to be transported on stretchers, a fee is applied at the rate of the applied fare with a premium of 200% regardless of how many seats in the aircraft the stretcher actually occupies.
SECTION 9. BAGGAGE
9.1. OBJECTS NOT TAKEN FOR TRANSPORTATION
AS THE BAGGAGE
The passenger should not include in his baggage:
Objects that can harm an aircraft, persons or property on the board of aircraft, including explosives, compressed gases, corrosive liquids, oxidizing substances, radioactive substances, magnetizable materials, flammable materials, poisonous, substances with a sharp smell or irritating substances, as well as liquids (with the exception of liquids in unregistered baggage that are intended for consumption during the journey of the passenger);
Objects, transportation of which is prohibited by laws, regulations, rules and provisions of state bodies of any country, to, from, of through the territory of which the transportation is carried out;
Objects which, in the opinion of the Carrier, are not, by their weight, size or other characteristics, acceptable for carriage as baggage;
Animals, excluding dogs, cats and other indoor (domesticated) animals and birds that can be accepted for carriage, subject to the provisions of item 9.15 of these Rules.
9.2. OBJECTS TAKEN TO TRANSPORTATION AS UNREGISTERED BAGGAGE IN LIMITED NUMBER AND WITH THE CARRIER'S AUTHORIZATION
Passengers are allowed to carry as unregistered baggage in limited quantities and with the permission of the carrier:
Items of hygiene and medicine that may be needed during the flight;
Dry ice, used for packaging and preserving perishables;
Alcoholic beverages in an amount not exceeding that permitted by laws, regulations, rules and provisions of the state bodies of any country in the territory from which or through the territory of which the transportation is carried out;
Tobacco products and accessories for smoking, including lighters only with liquefied absorbing gas;
Portable cylinders with oxygen, used exclusively for medical purposes;
Portable cylinders with carbon monoxide used to drive orthopedic devices.
9.3. FAILURE IN THE CARRIAGE OF BAGGAGE
The carrier may refuse to carry as baggage any items or substances specified in item 9.1 of these Rules, and may refuse to carry out subsequent transportation of any baggage if it is found that it includes such items or substances.
9.4. SPECIAL CONDITIONS OF CARRIAGE OF WEAPONS AND SOME KINDS OF SPECIAL EQUIPMENT
9.4.1 For persons who have the right to store and transport weapons but are not in the line of duty, weapons are withdrawn and for the duration of the flight they are handed over to the crew.
9.4.2 The transfer of weapons to themselves by persons who are in the performance of their official duties is carried out only with a permit issued in accordance with the established procedure and subject to the observance of the relevant laws, rules, regulations and prescriptions of state bodies of any country, on, from or through the territory shipping is carried out.
9.4.3 It is not allowed to use portable electronic equipment on the board of the aircraft, which can adversely affect the performance of aircraft systems and equipment. In order to ensure safety, the aircraft crew can at any time ask for the shutdown of personal electronic equipment.
- The following devices can be used at any time (unlimited use):
- Digital Watch;
- Electric razors;
- The use of the following devices is determined in accordance with the recommendations of the manufacturer of aircraft, equipment, as well as in accordance with the ICAO Technical Instructions for the Safe Transport of Dangerous Goods by Air (Doc 9284 AN / 905) and the Technical Instructions (Regulations) of ICAO (International Civil Aviation Organization) on dangerous goods of IATA (International Air Transport Association):
- Equipment to support the work of the heart (pacemakers) and other implanted medical devices
- Electronic stimulators of the nervous system
- Personal life support systems and pagers (receivers only).
- It is prohibited to use any powerful emitters (emitters) On the board of the aircraft, including the following devices:
- Mobile (cellular) phones, except when the aircraft is parked with open doors and is not refueled.
- Two-way transmitters, such as portable walkie-talkies, amateur radios and radios with a range of frequencies for service communication, millihertz transmitters, radio transmitters, other radio equipment;
- Devices intended to radiate radio frequency energy by certain frequencies;
- Peripherals for computers or games connected by cable;
- AM/FM radio receivers (amplitude/frequency modulation).
- Portable TV sets
- Remote controlled toys, remote devices
These devices are accepted for transportation only in packaged form.
- When the aircraft doors are closed, during taxiing, take-off, initial climbing, descent or landing, all portable electronic devices, including the equipment listed below and with the exception of those that are accepted without restrictions, must be switched off:
- Personal computers
- Peripheral devices for a personal computer
- Personal computers with games
- High-frequency transceivers-scanners
- Digital cassette player / sound recorder
- CD Player
- DVD player (DVD).
- VCR / playback systems
- GPS systems (global satellite navigation and positioning system).
Film, video and photographic apparatus, radio equipment and binoculars are accepted for transportation only in a packed form. Passengers are not allowed to use these items on the board of aircraft.
9.5. SCREENING OF PASSENGERS AND BAGGAGE
9.5.1 In order to ensure the safety of flights, protect the lives and health of passengers and crew members of the aircraft, the Turkmenistan Airlines OJSC authorities and other competent authorities of Turkmenistan are granted the right to inspect baggage (including unregistered baggage) and personal examination of passengers. Inspection is carried out at the airport or on an aircraft.
On an aircraft in flight, an inspection can be carried out if necessary, regardless of the passenger's consent.
For the purposes of this item, an aircraft is deemed to be in flight at any time from the closure of all its external doors after loading until the opening of any of these doors for unloading.
If the passenger refuses from inspection at the airport, the Carrier is entitled to terminate the contract of international air transportationation with the return of the sums paid for transportation in accordance with subitem 11.3.2 of these Rules.
9.5.2 Items that, in the opinion of Turkmenistan Airlines OJSC or other competent authorities of Turkmenistan, may endanger flight safety and are not allowed for carriage as unregistered baggage, are seized from passengers. The list of such items is established by Turkmenistan Airlines OJSC and the competent authorities.
The items seized during inspection should, if possible, be transported by the same flight that the passenger follows.
The order of transportation of seized items and their transfer to passengers at the points of transfer or destination are determined by the relevant rules and instructions of Turkmenistan Airlines OJSC.
9.6. REGISTERED BAGGAGE
9.6.1 During the reception of baggage for transportation, the Carrier is required to indicate in the ticket the number of seats and the weight of registered baggage, which is considered to be the issuance of a baggage ticket to the passenger. If the weight of the baggage is not indicated on the ticket, it is considered that the total weight of registered baggage does not exceed the free baggage allowance. In addition, the Carrier is obliged to issue a detachable baggage tag for the passenger.
9.6.2 After registration of the baggage, duties for its safety are assigned to the Carrier.
9.6.3 The carrier may refuse to accept baggage as registered if it is not packed in suitcases, cases, bags or other packaging that ensures its safe transportation under normal handling.
9.6.4 The passenger should not place in his registered baggage, and the Carrier may refuse to transport fragile or perishable items, money, jewelry, precious metals, securities, shares and other valuables, as well as business documents or product samples as registered baggage.
9.6.5 The registered baggage is carried on the same aircraft, which is followed by the passenger. If such carriage is impossible for any reason, the Carrier is required to transport the registered baggage with its nearest subsequent or previous flight.
9.6.6 If the Carrier accepts as baggage any items that do not comply with the definition of "baggage" given in these Rules, the carriage of such items is also subject to these Rules.
9.7. WEIGHT OF THE BAGGAGE AND RULES OF
FREE OF CHARGE BAGGAGE CARRIAGE
9.7.1 Each passenger who has a ticket, except for the case specified in subitem 8.4.9 of the present Rules, has the right to carry free of charge the established weight of the baggage corresponding to a class of the service stipulated by rules, orders and instructions of Turkmenistan Airlines OJSC is given.
9.7.2 If the international transportation is consistently performed on the international line, where the first class of service (including the lines of foreign carriers) is established, and on the international line of Turkmenistan Airlines, where the first class of service is not established, the passenger is granted the right to carry baggage free of charge at the rate corresponding to the first class of service, paid by the passenger.
9.7.3 If international transportation is consistently performed on international and domestic lines or vice versa, on the part of transportation on Turkmenistan Airlines OJSC domestic line the passenger is given the right to carry baggage free of charge at the rate corresponding to the class of service on the international line, which was paid by the passenger upon purchase of the ticket.
9.7.4 If the passenger changes the route of transportation and the class of service voluntarily, he is given the right to carry baggage free of charge at the rate established for the appropriate route or class of service in the new section.
9.7.5 If the route of transportation or class of service is forcedly changed, the passenger can freely carry the amount of baggage that he was allowed to carry on the originally paid route and class of service.
9.7.6 The passenger can take with him to the aircraft cabin the hand baggage (bags, etc.) under his responsibility, which is accepted for transportation as a rule for the carriage of free baggage. The weight of hand baggage should not exceed 5 kg, and its maximum dimensions should not exceed 50x40x20 cm.
9.7.7 Above the established norm of free baggage allowance the passenger is entitled to carry free of charge the following items if they are in the hands of the passenger and are not put into the baggage:
folder for papers;
coat or cloak;
umbrella or walking stick;
printed publications for in-flight reading;
food for the child and a children's road cradle;
wheelchair for the disabled person.
9.7.8 When two or more passengers, following as one group to the same destination or stop by the same flight, together present their baggage for carriage, they are granted the right to free transportation at a general rate equal to the a
