Chapter 1. TERMS. DEFINITIONS.

 

The aviation enterprise (carrier) is a civil aviation enterprise that carries out air transportation of passengers, baggage, cargo and mail for a fixed fee. Aviation enterprises are airlines and independent civil aviation airports.

 

The carrier's agent is a person (organization) authorized to act for the carrier or for another person (organization), as well as on their behalf.

 

Air terminal is a complex of facilities designed to serve departing and arriving of passengers.

 

The airport is a complex of facilities intended for the reception and dispatch of aircraft and air traffic services, which has for this purpose an airfield, an air terminal, other land installations and the necessary equipment.

 

Basic Airport (point) is an airport (point), in which the aviation company is based.

 

Initial Airport (point) is an airport (point), from which the flight begins according to the schedule (flight plan).

 

Final Airport (point) is an airport (point), in which the flight ends according to the schedule (flight plan).

 

Airport (point) of destination is the airport (point) to which the carrier must deliver passengers, baggage, cargo and mail according to the contract of air carriage.

 

Airport (point) of return flight is final Airport (point), from which the passenger who has a return ticket is returned.

 

Airport (point) of departure is the airport (point) from which the air transportation begins or continues according to the transportation document.

 

Intermediate airport (point) is an airport (point) located along the route of the flight, in which, according to the schedule (flight plan), landing of the aircraft is provided.

 

Stopover airport (point) is an intermediate airport (point) in which the passenger temporarily interrupts the flight.

 

Transfer airport (point) is the airport (point) marked in the ticket and baggage receipt, the air waybill, in which the passenger makes a transfer, as well as the cargo is reloaded from the aircraft of one flight to the aircraft of another flight for further transportation along the transportation route.

 

Baggage - personal belongings of passengers, transported on an aircraft by agreement with the carrier. Baggage can be registered and unregistered.

 

Registered Baggage - the baggage of passengers accepted by the aviation company for transportation under its own responsibility and for which it issued a baggage receipt and a baggage tag.

 

Unclaimed baggage - baggage that arrived to the airport (point) of destination indicated on the baggage tag, and was not received by the passenger.

 

Unregistered baggage (hand baggage) - passengers' baggage, except registered baggage, including marked by unlimited tags, carried on an aircraft and placed in its baggage compartments. Unregistered baggage is delivered to the board of the aircraft by the passengers themselves. Transported under the control and responsibility of the carrier, except for the period when the baggage is located at the passenger.

 

Unaccompanied Baggage - baggage not transported on the same aircraft, on which are the passengers or the crew who own this baggage.

 

Excess baggage is a part of the whole baggage that exceeds the free baggage allowance established by the carrier.

 

Baggage tag is a document issued by the carrier for the identification of registered baggage.

 

Baggage receipt is a part of the ticket that certifies the reception of baggage for the carriage.

 

Ticket is a document certifying the conclusion of an agreement for the carriage of passengers and baggage by air, includes a baggage receipt.

 

A group ticket is a ticket issued by an aviation enterprise or its agent at the request of another enterprise, organization or institution and certifying the conclusion of an air carriage agreement under one transport document of a group of passengers which have a common purpose of the trip, as confirmed by the document.

 

A ticket with a guaranteed date is a ticket showing the airport of departure, destination, flight number, date, time of departure of the aircraft, and there is a corresponding booking note.

A ticket with an open date is a ticket showing the airport (point) of departure, and destination, but not indicated the flight number and date of departure of the aircraft.

 

The tag indicated as "To the cabin" is a document authorizing the passenger to carry things that are not included in the set list of things carried with him in the cabin of the aircraft.

 

"Hand baggage" tag is a document authorizing the carriage of unregistered baggage in the cabin or in the baggage compartment of an aircraft.

 

Booking - preliminary fixation of a passenger's seat on an aircraft for a certain flight and date or preliminary fixing of the volume and tonnage for the carriage of baggage, cargo on the aircraft.

 

Permanent booking is a booking, allocated by the agency of air services to the disposal of another agency for the sale of transit (return) tickets.

 

Intermediate booking is a booking, allocated by the agency (airport), located in the intermediate aircraft landing places.

 

Refund of amounts is payment to a passenger or consignor of a cargo or to an authorized person of a part or all of the cost of transportation or services that they previously paid for, but not used.

 

The air line is an established line defining the points between which regular air transportation is carried out.

 

Air transportation of passengers, baggage and cargo (transportation) - transportation of passengers, baggage and cargo carried out by aviation enterprises On the board of the aircraft for a fixed fee, as well as by land transport means of the carrier.

 

An aircraft is an aircraft maintained in the atmosphere by its interaction with air reflected from the earth's surface.

Turkmenistan Airlines OJSC is the state management authority of civil aviation of Turkmenistan.

 

Cargo is property transported or accepted for carriage On the board of the aircraft, with the exception of baggage and mail. Unaccompanied baggage, issued by an air waybill, is also considered as a cargo.

 

Uncertificated cargo -is cargo that arrived at the airport without an air waybill and other necessary documents, or a cargo that is in a warehouse and has no documents.

Unowned cargo is a cargo, the ownership of which is not determined within 6 months from the date of its receipt at the airport.

 

Lightweight cargo is a cargo which volume exceeds 0.008 m3 per 1 kg of gross weight.

 

Unclaimed cargo is a cargo not received within 30 days from the date confirmed by the consignee's notification documents.

 

Oversized cargo is a cargo, the dimensions of one place of which exceed the overall dimensions of the loading hatches and cargo compartments of passenger aircraft on which it is carried.

 

Dangerous goods are products or substances which, when transported by aircraft, can create a significant threat to the life and health of passengers, flight safety and property safety.

 

Perishable goods are products of plant or animal origin, products of their processing, living plants, fish planting material and other goods that require special conditions for storage and transportation (optimum temperatures, humidity, etc.).

 

Transit cargo is a cargo, which according to the air waybill is transported further by the same flight to which it was delivered to the intermediate airport (point).

 

Transfer cargo is a cargo that, according to the air waybill, is delivered to Transfer airport (point) by one flight, and then is transported by another flight of the same or another carrier.

 

Heavy cargo is cargo weighing a single place of 80 kg or more.

 

Air waybill is a document certifying the conclusion of the contract for the carriage of goods by air, its terms and acceptance of the goods for transportation.

 

Cargo dispatch is one or several places of cargo, which are simultaneously accepted by the carrier from one consignor and are trarsported by one air waybill to the address of one consignee.

 

Cargo consignment is a cargo accepted for transportation from one consignor to one or several consignees under several air waybills.

 

Days are full calendar days, including Sunday and official holidays. To determine the validity of shipping documents, acts and other documents, as well as to determine the deadlines for the completion of transportation, the statute of limitations for the presentation of claims, the account is kept from 00 hours of the day following the day when the event occurred or effected; The rest of the hours of this day is not taken into account. If the end of any deadlines indicated earlier falls on a holiday or a Sunday day, the expiration of the term is determined by the day following it.

 

Contract of a chartered flight (charter party) is an agreement between the carrier (charterer) and the customer (charteree), as a result of which the carrier undertakes to provide the customer for a fee all the capacity or part of the capacity of one or several aircraft for one or several flights for the transport of passengers, cargo, mail or for other purposes.

 

Inspection is a screening check conducted by civil aviation and police officers to ensure flight safety, to prevent the transport of explosives and other dangerous goods and items.

 

Receipt of paid baggage is a document confirming the payment of the transportation of baggage in excess of the free baggage allowance or items that are subject to mandatory payment, as well as the payment of the charges for the declared value of baggage.

 

The clientele of civil aviation are ministries, state committees, departments, enterprises, institutions, organizations and citizens using air transport services.

 

Route of transportation is specified in the ticket (for the carriage of goods in an air waybill) in a certain sequence of airports (points) of departure, transfer, stop and destination point.

 

Failure of transportation means any violations of the order of work (delivery of baggage or cargo, shortage by weight or number of packages, damage, loss, disconnection of documents and cargo, improper execution of shipping documents) that caused or could have harmful consequences.

 

Stop - agreed by the passenger with the carrier a temporary break in the carriage at any point between the points of departure and destination point.

 

The consignor is an organization or a person which has concluded an air transportation contract with an air company and indicated in the air waybill as the consignor of the goods.

 

A passenger is a person, with the exception of crew members, who is transported or to be transported on an aircraft in accordance with the contract of air carriage.

A transit passenger is a passenger who, in accordance with the contract of air carriage, follows further by the same flight as he arrived at the intermediate airport (point).

 

The transfer passenger is a passenger who, according to the contract of air transportation, has arrived to transfer airport (point) by one flight and continues the flight by another aircraft.

 

Transportations by shifts (shift-forwarding method of transportation) - transportation by aircraft of brigades of workers and employees from the place of residence to the place of work and back, as well as the transportation of the baggage belonging to them and the cargo transported with them.

 

Group transportation is the transportation of a group (10 or more people) having the overall purpose of the trip, as confirmed by the document, regardless of whether it is issued by a group ticket or by separate tickets for each passenger.

 

Transportation "there" - transportation in one direction between the point of departure and the destination point (regardless of whether the landing of the aircraft, the transfer of passengers or transhipment of cargo at the intermediate airport have taken place).

 

Transportation "there" and "back" - transportation of passengers to the destination and back on tickets sold for the flight "there" and "back".

 

Transportation in a direct mixed flight is transportation carried out by carriers of different modes of transport under one document with the participation of air transport.

 

Period of transportation:

 

  • Passenger air carriage covering the time period from the moment the passenger enters the airport platform to board an aircraft and until the passenger leaves the platform under the supervision of the authorized persons of the carrier;

 

  • air baggage transportation covering the period of time from the moment of its acceptance to transportation and before before handing over to the consignee or transfer thereof according to the established rules of another organization;

 

  • air transportation of the cargo covering the period of time from the moment of its acceptance to transportation and before handing over to the consignee or transferring it according to the established rules of another organization.

The apron is part of the airfield of a civil aerodrome designed to accommodate aircraft for the purpose of landing and disembarking passengers, loading and unloading baggage, cargo and mail, as well as for other services.

 

Damage to baggage, cargo - bringing baggage, cargo, during transportation into an unusable condition, as a result of which they can not be fully used for their original purpose (lost their value).

 

Claim is the claim to the aviation company from the clientele of civil aviation for compensation for damage caused by air transportation.

 

Flight is the flight of an aircraft (scheduled or out of schedule), performed in one direction from the initial to the final point of the route.

 

A supplementary flight is a flight performed in addition to the schedule on the same route as regular flights.

 

Registered flight (charter) is a flight performed on the terms of the contract of a custom flight (charter contract), concluded by the customer for the delivery of passengers, cargo and mail to the destination point.

 

Interrupted flight is a flight, the performance of which is suspended at an intermediate airport or at another airport (point).

 

The fee is a fee established by OJSC Turkmenistan Airlines, to partial reimbursement of losses for refusal of air transportation or from booking.

 

The fee for services is a fee established by the carrier or other competent authorities for special or supplementary services related to air transportation.

 

Fare is the amount approved in the prescribed manner and charged by the carrier for transportation of a passenger, or for transportation of a unit of weight or volume of baggage, cargo, mail.

 

Loss of baggage, cargo is failure of transportation, in which the carrier, upon expiry of the time set for delivery, is unable to issue the baggage accepted for carriage to the authorized person, regardless of whether it occurred as a result of their actual loss, theft, sending or erroneous delivery in the interim Airport.

 

 

CHAPTER 2. GENERAL PROVISIONS

                                               

2.1. Applying of rules

 

2.1.1. The present Rules regulate the transportation of passengers, baggage and cargo carried out by the airlines and airports of OJSC Turkmenistan Airlines.

                                                                                                 

The rules define the duties, rights and responsibilities of aviation enterprises, as well as other enterprises, institutions, organizations and citizens which use air transport, and are obligatory for them.

 

2.1.2. Air transportation of passengers, baggage and cargo for an established fee is carried out by the airlines and airports of Turkmenistan Airlines OJSC.

 

Other ministries, departments and organizations that have aircraft can carry passengers, baggage and cargo for their own needs, except in cases stipulated by the legislation of Turkmenistan. Such transportations do not fall within the scope of these Rules.

 

2.1.3. The present Rules, as well as instructions and other documents regulating the transportation issued in their development, can be changed by Turkmenistan Airlines OJSC without prior notification. However, if the carriage is carried out or has already been completed, such changes to this shipment do not apply.

 

Officials, agents and representatives of an aviation enterprise shall not have the right to revoke or change the requirements of these Rules and the instructions and other documents issued in their development.

 

The terms of the contract of air carriage, contrary to these Rules, are recognized as invalid.

 

2.1.4  When transporting passengers and baggage, the rules, fares and fees that apply on the day of departure of the passenger from the initial airport indicated in the ticket and baggage check are applied. When cargo is transported, the rules, fares and charges apply, which are effective on the day the consignor receives the air waybill.

 

2.1.5.         The application of fares for transportation of passengers and cargo, as well as the collection of fixed fees are made in accordance with the "Rules for application of fares for the air lines of OJSC Turkmenistan Airlines.

2.1.6. Air transportation of passengers, baggage and cargo carried out under the contract of charter (charter) flight, as well as the shift-expeditionary method On the board of the aircraft of the aviation enterprise, is carried out in accordance with these Rules and special instructions of OJSC Turkmenistan Airlines.

 

2.1.7. Air transportation of passengers, baggage and cargo carried out by aircraft leased from an air company is regulated by these Rules and the terms of the aircraft lease contract.

 

2.1.8. Military air transportations and special cargo shipments are regulated by these Rules, as well as special instructions of OJSC Turkmenistan Airlines.

 

2.1.9. Conditions for the transport of weapons, ammunition, explosive, poisonous, flammable, radioactive and other dangerous substances and objects, film-making and photographic apparatus, radio equipment and others are determined by special rules established by the Cabinet of Ministers of Turkmenistan.

 

2.1.10.

The air transportation of perishable cargo is regulated by these Rules and special instructions of OJSC Turkmenistan Airlines.

 

2.1.11.

The transportation of passengers, baggage and cargo carried out by carriers of different modes of transport by one document (in direct mixed communication) with the participation of air transport is regulated by the legislation of Turkmenistan on such transportations, the rules approved by OJSC Turkmenistan Airlines, in conjunction with the relevant transport ministries and departments.

 

2.1.12.

Service air transportation of passengers, baggage and cargo is regulated by these Rules, as well as by special instructions of OJSC Turkmenistan Airlines.

 

2.1.13.

The transportation of passengers, baggage and cargo regulated by the present Rules is subject to the Air Code of Turkmenistan, as well as other laws, acts of the President, orders and instructions of OJSC Turkmenistan Airlines, as well as other state bodies of Turkmenistan.

 

2.1.14.

All questions concerning the application of these Rules and arising in the relations between passengers, consignors, consignees and officials of the aviation enterprise or its agents which are in the discharge of duties are resolved: at airports, by the commander (chief) of the aviation enterprise, the chief of the airport or the head of the transportation organization service; In agencies by the head of the agency; During flight by the commander of an aircraft.

 

The procedure for submission and consideration of claims and demands arising from the contract for the carriage of passengers, baggage and cargo by air is specified in Chapter 9 of these Rules.

 

2.1.15.

At airports, city agencies (air terminals) and on the board of the aircraft should be kept a book of comments and proposals. The book of comments and proposals should be submitted at the first request of persons wishing to make a record in it. According to the Law of Turkmenistan dated 14.01.1999 "About the claims of citizens and the procedure for their consideration", citizens' applications are allowed within a period of not more than one month from the date of receipt, and those that do not need additional verification - immediately, not later than fifteen days from Day of their receipt. In cases where a special inspection or examination of a significant amount of material is necessary to resolve the request, the head of the relevant body, enterprise, organization, institution or his deputy shall fix the necessary period for its resolution, which shall be notified to the person who submitted the appeal. At the same time, the total period for the resolution of circulation should not exceed forty-five days. The applicant must be notified about the results of consideration of his comments and proposals. The entry in the book of comments and proposals does not exclude the need to present claims specified in these Rules.

 

2.1.16.

The international air transportation of passengers, baggage and cargo is regulated by the Rules for International Air Carriage approved by OJSC Turkmenistan Airlines.

 

2.1.17.

The air transportation of mail is regulated by the Rules for the carriage of mail, approved by Turkmenistan Airlines OJSC and the Ministry of Communications of Turkmenistan.

 

2.2. Contract of carriage by air

     

2.2.1. Under an air carriage contract for a passenger, the airline undertakes to transport the passenger and his baggage to the destination point by providing him with a seat on an aircraft flying the flight indicated on the ticket and, in the event that the passenger passes the baggage, also deliver the baggage to the destination point and give it to the person entitled to get the baggage. The passenger is obliged to pay for transportation at the established fare, and when passing the baggage in excess of the established rate - and for transportation of this baggage.

2.2.2. Under the contract for the carriage of goods by air, the carrier undertakes to deliver the cargo entrusted to it by the consignor to the destination point and to issue it to the person entitled to receive the goods, and the consignor undertakes to pay for the carriage of the goods at the established fare.

 

2.2.3. Each air transport contract and its terms are certified by a transportation document issued by the aviation enterprise or by authorized organizations or persons (agents).

 

         The traffic documents are:

         when transporting a passenger                            - a ticket;

         when transporting a passenger's belongings as a

         baggage                                                           - baggage tag;

         when carrying hand baggage                              - hand baggage tag.

 

Forms of transportation documents and the rules for their application are established by OJSC Turkmenistan Airlines.

 

2.2.4. The Carrier shall issue as the certificate of additional sums paid to it by the passenger, the consignor or the receiver, due in the cases specified by these Rules:

 

the receipt about different charges - when paying by the passenger, consignor or receiver of fees and payments related to the change of the contract of air carriage, service, as well as the payment of fines;

 

the receipt of paid baggage - if the passenger pays the baggage in excess of the established rate for free of charge transportation;

         other documents certifying payment.

 

Forms of payment documents and instructions for their application are established by OJSC Turkmenistan Airlines.

 

2.2.5. Transportation of passengers, baggage and cargoes, carried out from the airport of departure to the airport of destination by several aviation enterprises under one transport document (including the additional shipping document issued with it) is considered as a single contract of carriage, irrespective of whether the were transfers, transshipments, or interruption in transportation.

 

2.2.6. Transportation of the passenger in the directions "there" and "back" is considered as two separate contracts of transportation.

 

 

2.3. Timetable

     

2.3.1. Regular transportation of passengers, baggage and cargo is carried out by air lines in accordance with the established timetable.

 

The carrier, in accordance with the procedure established by OJSC Turkmenistan Airlines, is entitled to make changes to the timetable without prior notification of passengers and consignors. In cases when tickets have been sold according to timetabled flight, the time of departure of the aircraft can be changed only for reasons beyond the control of the carrier, subject to the requirements of section 3.13 of these Rules.

 

2.3.2. For information of the population, enterprises, organizations and institutions about the opening of new airlines, the commissioning of new types of aircraft, the frequency of flights, the introduction of new types of services, forms of passenger service, the carrier is obliged to conduct information and promotional activities aimed to attracting passengers and cargo.

 

2.4. Transportation route

 

Transportation of passengers, baggage and cargo is carried out on the route of transportation, corresponding to the paid fare for transportation. Change of the route specified in the shipping document, except for the cases specified in section. 2.5 of these Rules may be made by agreement between the carrier, passenger, and consignor (consignee) of the goods.

 

2.5. Special rights of the carrier

 

2.5.1. The carrier is entitled to cancel, delay or postpone the flight of the aircraft for another time, change the scheduled route of transportation, and change the landing point if necessary:

 

due to a natural disaster, adverse meteorological conditions at airports of departure, destination or along the route of transportation, as well as other phenomena affecting flight safety;

 

to meet the requirements of government agencies.

 

2.5.2. The carrier is entitled to replace an aircraft of the same type with another. In the event of a passenger refusing to fly on another type of aircraft, the carrier must send the passenger one of the next flights or return him money for unfulfilled transportation and charges in accordance with the Rules for the application of fares.

2.5.3. The carrier may temporarily stop or restrict the sale of tickets in the directions "there" and "back", as well as reception for the carriage of the goods. The carrier must declare such restrictions to the public at the appropriate airports and agencies.

 

2.5.4. The carrier is entitled to refuse the passenger in carriage in the following cases:

 

the need to ensure the safety of the flight of an aircraft;

 

the need to meet the requirements of government agencies;

 

a passenger's illness, the condition of which creates danger for the patient himself or for others;

 

violation by the passenger of the established rules for the use of air transport and disobeying the orders of the commander of the aircraft or other officials of the aviation enterprise;

 

finding a passenger in a state of intoxication;

 

violation of public order by the passenger;

 

creation by the actions of the passenger direct threat to the safety of the flight or the life of passengers or crew on the board of the aircraft.

 

In case of refusal to transport for the reasons stipulated by this items, the carrier shall draw up acts according to the form established by OJSC Turkmenistan Airlines.

 

2.5.5. The carrier is entitled at any time to replace the seat provided to the passenger in the cabin of the aircraft to another cost-equal place, if necessary in order to ensure flight safety.

 

2.5.6. In the event that, for reasons dependent on the passenger, the conditions of carriage change and the passenger is obligated to pay the additional fares for transporting or providing paid services to the carrier, the carrier is entitled to refuse the passenger in carriage if the passenger does not pay the amount due. In this case, a refund is made for the unfulfilled transportation in accordance with the rules for the application of fares. From the amount refunded to the passenger, the carrier is entitled to withhold all amounts due to it, including the fees established in Section 3.16 of these Rules.

2.5.7. The carrier is entitled to open the package of cargo in the presence, as well as in the absence of the consignor or the consignee, when this is caused by the need to ensure the safety of the cargo or to verify the detected malfunctions.

 

Opening of the package is carried out in the following cases:

 

violation of packaging or damage to cargo;

 

detection of shortage by weight against the weight specified in the air waybill (with the exception of cargo arriving in good packaging and with good seals of the consignor);

 

the need to establish the nature and condition of a non-documented cargo;

 

the carrier has doubts about the correctness of the cargo name or the data reported by the consignor about the properties and nature of the goods;

 

requirements of authorized state bodies, as well as experts and auditors.

 

Opening of the package of cargo is carried out by a commission appointed by the chief of transportation organization of an aviation enterprise. The cargo packages after their opening should be re-packed and sealed with the seal of the airport that opened the cargo. About the opening of the cargo an act is drawn up, one copy of which is attached to the consignor's air waybill.

 

2.6. Exceptional cases of non-application of the rules.

 

«Turkmenhovayollary» Service, in agreement with the interested ministries, departments, enterprises, institutions, organizations (consignors or consignees) in exceptional cases where, due to special circumstances, the carriage of goods can not be carried out on the basis of these Rules, it may establish the procedure for its transportation under special conditions, not provided by these Rules.

 

 

CHAPTER 3. TRANSPORTATION OF PASSENGERS

 

3.1. Passenger ticket

 

3.1.1. Each passenger is required to have a ticket of the established form. Resale and transfer of the ticket to another person is FORBIDDEN. If the resale or transfer is established, the ticket is canceled and its value is not refunded.

A passenger who does not show a ticket is not allowed to be transported.

 

The lost tickets are not renewed, duplicates are not issued, and the amount paid for the ticket is not returned.

 

3.1.2. The ticket is issued on the basis of the identity document of the passenger:

passport or the document replacing it.

 

3.1.3. The ticket is issued after payment the established rate. When making the transportation by bank transfer or credit, as well as preferential transportation, the ticket is issued after the submission of documents that are the basis for obtaining a ticket.

 

3.1.4. The passenger is required to keep the ticket until the end of the transportation, and in case of a claim - until it is resolved. The ticket must be presented at the first request of officials of OJSC Turkmenistan Airlines, an aviation company and its agents authorized to inspect shipping documents.

 

3.1.5. The ticket gives the right to fly only between the airports of departure and destination and through the airports of the transfer, or stopover specified in the ticket.

 

3.1.6  Tickets are sold at the ticket offices in order of priority. The right to extraordinary purchase of air tickets have the following authorities:

 

a)      Khalk Vekilleri (People Representatives) of Turkmenistan, Deputies of the Mejlis of Turkmenistan, Heroes of Turkmenistan and persons awarded the Order of the Star of the President, Medals of Edermenklik, Gayrat, Heroes of the Soviet Union, Heroes of Socialist Labor, and persons awarded with Orders of Labor Glory of 3rd Degree, For Service to the Motherland in the Armed forces of the USSR and Turkmenistan;

 

b)      persons, travelling in accordance to certified telegraph call associated with an accident;

 

c)      employees of the Emergency and Scheduled Medical Advisory Service of the Ministry of Health and Medical Industry of Turkmenistan;

 

d)      participants of the Second World War, disabled workers of the 1st  and 2nd group, who purchase tickets for themselves and for persons with them (one or two, depending on the state of health of the disabled person);

 

e)      servicemen, who have been diagnosed with a disability associated with the performance of an international duty, soldiers-internationalists;

 

f)      persons with children under 5 years of age and with permits for sanatorium treatment with children under 16 years of age, as well as with 2 or more children in return for up to 12 years;

 

g)      employees of Turkmenistan Airlines OJSC State National Service named after the Saparmurat Turkmenbashi the Great;

 

h)      transfer passengers, untimely delivered to the points of transfer;

 

i)       passengers, travelling by tickets with an open date (issued on demand for issuing of service air tickets and for coupons for the right to receive free travel or with a 50% discount from the applicable fare);

 

j)       personal pensioners of republican importance, pensioners for special services to Turkmenistan;

 

k)      employees of the Ministry of  National Security of  Turkmenistan, for official purposes;

 

l)       employees of the prosecutor's office of Turkmenistan, for official purposes;

 

m)     employees of the internal affairs bodies of Turkmenistan, for official purposes;

 

n)      servicemen on their business trips, to a new place of military service, as well as to the place of vacation and back;

 

o)      employees of the State Customs Service of Turkmenistan for official purposes;

 

p)      employees of the State Border Service of Turkmenistan for official purposes.

 

3.1.7. When selling tickets for a flight carried out with boardings on the route, the priority right to purchase the ticket is given to the passenger who is travelled to the final airport. The carrier is entitled to refuse the passenger to sell the ticket to the point of intermediate landing of the aircraft.

 

3.1.8. Tickets for transportation in the direction "there" are sold only with a guaranteed date of departure from the departure airport. Tickets for transportation with transfers, passenger stops on the way, as well as in the direction of "back" are sold both with guaranteed, and with an open date of departure from the airports of transfer, stopover or return.

 

For the passengers to be dispatched on vacant places, revealed before the departure of the aircraft, the sale of tickets with an open date "for a landing" is permitted. Sale of such tickets is carried out only at the airport.

 

It is allowed to sell tickets for flight in the opposite direction and for departure from another airport, regardless of whether the passenger purchases a ticket for the flight to this airport.

 

The order of ticket sales is determined by the "Guide for the organization of ticket sales and booking of seats on civil aviation flights of Turkmenistan" approved by OJSC Turkmenistan Airlines.

 

3.1.9. The carrier is entitled to recognize the ticket as invalid if:

     

any part of the ticket is damaged or corrected;

 

the ticket does not have a cash stamp, which issued it (except for tickets issued through an automated system);

 

the ticket does not have a control coupon for the shipment or part thereof;

 

incorrectly drawn up a monetary interval of the ticket (except for tickets issued through an automated system).

 

Tickets that are declared invalid for reasons depending on the carrier, if necessary, are subject to exchange. Tickets deemed void for reasons beyond the control of the carrier are selected and not replaced. In all such cases, the carrier shall make the act.

 

3.1.10.

A person found on the board of aircraft without a ticket or with a ticket recognized as a void by the carrier is to be landed at the first airport of landing. For a ticketless flight of a passenger or child who must have a children's ticket, for transportation for the child ticket of a child over 12 years old, who must have a ticket with a full passenger fare, and for a flight on a privileged (service) ticket without the relevant documents, a fine in the amount provided by the rules for the application of fares is stipulated.

 

 

Payment of a penalty does not exempt a passenger from paying for the cost of a flight for actually performed transportation at a fare established in air transport for the relevant passenger category.

 

3.2. Validity of tickets.

     

3.2.1. The expiry date of the ticket includes:

        

Total term of validity;

     

Term of validity for the flight.

 

The total period of validity gives the passenger the right to use the ticket for all operations provided for in these Rules, including for getting a seat for a certain flight and date, refund of amounts for a fully or partially unfulfilled carriage and for other settlements established by these Rules.

 

The total period of validity of the ticket covers the period from the moment of issuance of the ticket to the passenger and until the end of the period provided to it for receiving money for the unused ticket.

 

3.2.2.         A ticket with a guaranteed date provides the right to a flight from indicated initial airport, transfer airport, stopover airport or the airport of the return flight only on the date and the flight that it indicates.

     

A ticket with an open date entitles you to a flight from the corresponding airport only after the carrier has entered the departure date and the flight number, and place.

 

3.2.3.         The ticket is valid for the flight for the following periods:

 

A ticket with a guaranteed departure date - during the entire period of transportation by the flight indicated in the ticket;

 

A ticket with an open date in the direction of "back", as well as a ticket with an open date, sold from another city within 6 months from the date of ticket sale;

 

A ticket with an open date "for a transfer" within 2 days from the date it was issued.

3.2.4. Tickets sold at reduced rates are valid for the flight within the established expiration dates, but within the time limits for which preferential fares are introduced.

 

3.2.5. The carrier is obliged to extend the period of validity of the ticket for a flight for the time necessary for transporting passengers to the destination point, if the ticket is not used within the established period of validity by reason of:

 

cancellation or delay of the flight indicated in the ticket;

 

failure of the aircraft to land at the airport indicated in the ticket;

 

failure to send a passenger by reason of inability to provide him a seat on the flight and the date specified in the ticket;

 

return of the aircraft that failed to perform the flight to the airport of departure;

 

failure to send a passenger from a transfer airport by the flight specified in his ticket, due to late arrival of the aircraft or cancellation of the flight to which the passenger should arrive at the airport of transfer;

 

         replacement of the aircraft type specified in the timetable;

 

a break in the flight by the reason of the forced landing of the aircraft;

 

illness of the passenger or a member of his family, accompanying him on the board of the aircraft;

 

         incorrect registration of the ticket by the carrier.

 

The carrier may, but is not obliged to, extend the validity period of the ticket for other reasons, if he considers them respectful. The carrier is obliged to make a note on the ticket to extend the period of its validity.

 

3.2.6. The ticket can be submitted to the carrier for the refund of the amounts for partially or completely unfulfilled transportation:

 

before the start of transportation;

 

during the whole validity period of the ticket for the flight;

within 10 days after expiry of the validity period of the ticket for the flight by citizens and organizations purchasing tickets for cash or by military transportation documents;

 

within 30 days after the end of the validity period of the ticket by enterprises, organizations and institutions that purchase tickets by bank transfer or on credit.

 

Refunds for unused tickets are made in compliance with the rules of application of fares.

 

3.2.7. Expiration of the validity periods of the ticket specified in this article does not deprive the passenger of the right to present claims and demands to the carrier in compliance with the requirements of the Air Code of Turkmenistan and these Rules.

 

3.3. Transportation of children.

 

3.3.1. On local air routes of Turkmenistan, children can be transported accompanied or unaccompanied by adult passengers. Unaccompanied (without parents, relatives, guardians and not trusted by any of the passengers), children between the ages of 5 and 12 can be transported by air. Unaccompanied children are accepted for transportation only after registration by the parents (relatives, guardians) of the application for transportation of the unaccompanied child and the declaration of responsibility of the parent (relative, guardian), indicating all the necessary data for transportation. At the request of parents (relatives, guardians), this can apply to children under 16 years.

 

The order of transportation of unaccompanied children is determined by the "Instruction about the procedure for transportation of children on local airlines withous accompanying by adult passengers on local air routes of Turkmenistan" approved by the order of the head of Turkmenistan Airlines OJSC State National Service named after the Saparmurat Turkmenbashi the Great dated 02.04.2005, No. 77 and registered by the Ministry of Justice (Adalat) of Turkmenistan on May 3, 2005, No 345.

 

3.3.2. A passenger can carry one child under the age of 5 free of charge without giving the child a separate seat. Other children under the age of 5 years traveled together with the passenger, as well as children between the ages of 5 and 12 years shall travel by children's tickets with a separate seat.

 

3.3.3. The age of the child is determined on the day of the beginning of transportation from the starting point of departure indicated in the ticket.

3.3.4. The carrier is entitled to check the age of the child. The passenger accompanying the child must submit to the Carrier when buying a ticket and boarding an aircraft (at registration) a document proving the age of the child: the child's birth certificate or the passport in which the child is recorded.

 

3.3.5. Group transportation of children (to kindergartens, recreation centers for children) is carried out in the order established by OJSC Turkmenistan Airlines.

 

3.4. Transportation of transit passengers and passengers with return tickets

 

3.4.1. A passenger who has a transit or return ticket with a guaranteed departure date must be sent from the transfer, stopover or return flight airport to the date and flight specified in the ticket. The carrier is obliged to warn the passenger that he is obliged to come to the airport of transfer, airport of stopover or return departure for ticket registration and baggage clearance.

 

3.4.2. A passenger who has a transit or return ticket with an open departure date must go to the agency or the transfer, stopover or return flight airport in order to continue the transportation for getting a seat on a certain flight. If it is impossible to send a passenger a desirable flight for him, the carrier must offer the passenger a seat for another flight or for another departure date. If the passenger refuses from the carrier's proposed flight or departure date, the carrier, at the request of the passenger, must return the money for the unfulfilled carriage by ticket in accordance with the rules for the application of fares.

 

3.5. Transportation of a sick passenger and medical personnel

 

3.5.1. The passenger is obliged to determine the possibility of using air transport based on his state of health.

 

The carrier shall not be liable for the deterioration of the health of the passenger or other consequences arising during the transportation or after it caused by the age, mental or physical condition of the passenger.

 

3.5.2. A passenger whose physical condition causes the carrier to fear for his health (seriously ill patients, patients on stretchers, etc.) is admitted to air transportation upon presentation of the certificate of the medical institution that such passenger is not contraindicated for transportation by air transport, and, if necessary, that his illness is not dangerous to other persons.

3.5.3. Transportation of seriously ill patients and patients on stretchers is carried out only accompanied by persons providing care for the sick passenger during his flight. Transportation of patients on stretchers is made with the provision of their place in an aircraft with payment according to the fare established by the rules for application of fares for such transportations.

 

In those cases when the patient can not be moved from the stretcher to the chair, the possibility of his transportation is determined by a preliminary agreement between the carrier and the persons accompanying the patient.

 

The carrier shall have the right to refuse carriage of the patient on stretchers in the absence of the conditions necessary for the carriage of such patients on the aircraft.

 

The rules of this section do not apply to transportation of patients by registered flights and sanitary aircraft.

 

3.5.4. Transportation of doctors and nurses to patients (in cases that threaten the life of the patient), as well as transportation of patients and medical personnel to the nearest treatment and prophylactic institution on local air lines is free of charge for tickets issued on the basis of a coupon and a special certificate for the right to free use transport, issued by the health care institution.

 

3.6. Ordering places for citizens.

 

3.6.1.         Citizens can order seats on the aircraft in person and by phone.

 

3.6.2. A fee is collected for the order, established by the rules for the application of fares.

 

3.6.3. Acceptance of orders is carried out within the deadlines set by the "Guide for the organization of ticket sales and booking of seats on civil aviation flights of Turkmenistan." Customized tickets are delivered to the address specified by the passenger, or sold at special ticket offices of agencies in a time agreed with the passenger.

 

3.6.4. One-time booking of places for sending participants to meetings, conferences, rallies, etc. is allowed. (No more than 9 seats in one direction). Booking is carried out at the permission of the head of the agency on the basis of the application of the organization that conducts the specified event, provided that the fee for each booked place is paid in the amount provided for by the rules for the application of fares.

3.6.5. Enterprises, organizations, institutions during meetings, conferences, rallies and other weight events can draw up a written application for sending cashiers to sell tickets directly to venues or to hotels where their members live. The application must confirm the obligation to provide the transport of the enterprise with the delivery of the cashier to the ticket sale place and, at the end of the work, back to the agency. The fee for the cashier's departure is paid in the amount and in the order established by the rules for the application of fares.

 

3.6.6. The procedure for booking seats is determined by the "Guide for the organization of ticket sales and booking seats on domestic civil aviation air lines of Turkmenistan.

 

3.7. Ordering places for applications from enterprises,

institutions, organizations.

 

3.7.1. Ministries, departments, enterprises, institutions and organizations can apply in advance to reserve seats for groups of 10 or more people, as well as the seats of the entire aircraft.

 

3.7.2. When ordering places for transportation of groups of 10 or more people, as well as the locations of the whole aircraft, the customer is obliged to pay a guarantee deposit in the amount provided by the rules for the application of fares. If the customer has not made a guarantee deposit 10 days before the departure of the aircraft, the order is canceled and the carrier is entitled to use the vacant seats at its discretion.

 

3.7.3. Tickets for orders of enterprises, institutions and organizations that have made a guarantee advance must be received from the carrier no later than 3 days prior to the departure of the aircraft.

 

If tickets are not received within the specified period, the carrier is entitled to cancel the order and use the vacant seats at its own discretion.

 

3.7.4. Enterprises, institutions and organizations that have made a guarantee deposit have the right to cancel the order in whole or in part at least 7 days before the aircraft departure. In this case, no deductions from the guarantee deposit are made.

 

If the customer refused to purchase tickets less than 7 days before the aircraft departure or did not receive them (in whole or in part), the fee for the unused order, in accordance with the fare application rules, is withheld from the customer's guarantee adv
